Terms of Service
Last updated October 17, 2026 · Privacy Policy
These terms are an agreement between you and Andrew Dysart, who runs EmoteMaker.ai (“EmoteMaker”, “we”, “us”). They cover the website at emotemaker.ai and everything you do on it. By creating an account or using EmoteMaker, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use EmoteMaker.
1. Who can use EmoteMaker
You must be at least 13 years old. If you’re under 18, you need permission from a parent or guardian, who agrees to these terms for you. If you use EmoteMaker for a business or a channel you run with others, you confirm that you can accept these terms for it.
2. Your account
- Keep your sign-in secure. You’re responsible for what happens in your account.
- One account per person. Making extra accounts to collect more free credits isn’t allowed.
- If you think someone else is using your account, email support@emotemaker.ai.
3. Credits and payments
- You spend credits to generate, edit and animate images. Credit costs are listed in the app and on our pricing page.
- You can buy credit packs. Credits don’t expire. They have no cash value, can’t be transferred or sold, and can only be used on EmoteMaker.
- Some purchases are one-off, such as a single clean download or the Channel Starter Kit. They’re delivered as soon as you pay.
- Stripe processes our payments. Prices are in US dollars and shown before you pay. Taxes may apply.
- Subscriptions renew automatically each billing period until you cancel. Cancel any time from Manage Subscription in your account menu or by emailing support@emotemaker.ai. Your subscription stays active until the end of the period you’ve paid for, and its credits stay in your balance.
- We may change prices and credit costs. Changes apply to future purchases and generations, not to credits you already have.
4. Free credits and previews
New accounts get free welcome credits, and free previews are watermarked and limited each day. These are a gift to help you try EmoteMaker: we may change, limit or end them at any time, they have no cash value, and we may remove them from accounts that abuse them, for example by making several accounts.
5. Refunds
- Unused credit packs: you can get a full refund within 14 days of buying a pack if you haven’t used its credits, meaning your balance still holds all of that pack’s credits. Email support@emotemaker.ai from your account’s email address. We remove the pack’s credits when we refund it.
- Spent credits aren’t refundable.
- Failed generations: if a generation fails, the credits it used go back to your balance automatically.
- One-off purchases such as downloads and the Channel Starter Kit aren’t refundable once delivered. If one doesn’t arrive or doesn’t work, email us and we’ll fix it or refund you.
- Subscriptions: cancelling stops future renewals. We don’t refund the rest of a period you’ve already paid for.
This section doesn’t limit any refund rights you have under the law where you live.
6. What you make
- You keep the rights you have in what you upload and in the emotes and images you make with EmoteMaker. In some countries, including the US, images made by AI get limited or no copyright protection, so we can’t promise that no one else can use something similar.
- You can use what you make for personal or commercial purposes, including as emotes on Twitch, Discord, YouTube and Kick, as long as you follow these terms and each platform’s rules.
- AI can produce similar results for different people. You don’t get exclusive rights to an idea, a style or a prompt.
- You give us permission to store, process and show your prompts, uploads and creations as needed to run EmoteMaker, which includes sending them to the AI services that generate your images. If you choose to make an emote public, it can appear on public pages of the site.
- Only upload images you have the right to use. Don’t upload photos of other people without their permission.
7. Rules for using EmoteMaker
Don’t use EmoteMaker to make, upload or share anything that:
- is illegal, or sexualizes minors in any way (we report it to the authorities);
- is sexually explicit, or harasses, threatens or promotes hate against anyone;
- infringes someone else’s copyright, trademark, privacy or likeness;
- breaks the rules of the platform where you’ll use it.
And don’t:
- try to get around credit costs, watermarks, limits or security;
- use bots or scripts to access or scrape the site, other than through features we provide;
- resell access to EmoteMaker or its AI features;
- interfere with the site or with other people’s use of it.
We may remove content and suspend or close accounts that break these rules.
8. Email
When you create an account, we email you about it: verification, receipts and anything you’ve bought. We also send tips, product news and offers. Every marketing email has an unsubscribe link. Unsubscribing stops marketing email, but not email about your account and purchases.
9. Other services and trademarks
EmoteMaker relies on services run by other companies, such as sign-in, payments and AI models, and their terms may also apply. Twitch, Discord, YouTube and Kick are trademarks of their owners. EmoteMaker isn’t affiliated with or endorsed by them.
10. Ending your account
You can stop using EmoteMaker at any time. To delete your account and its data, email support@emotemaker.ai from your account’s email address. We may suspend or close an account that breaks these terms, or when the law requires it. If we close your account for breaking these terms, its credits are lost. We may change or discontinue parts of EmoteMaker; if we shut it down entirely, we’ll tell you by email first.
11. Disclaimers
EmoteMaker is provided “as is” and “as available”. AI results vary and can be unexpected, inaccurate or unsuitable, so check what you make before you use it. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don’t promise that EmoteMaker will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about EmoteMaker is limited to the greater of what you paid us in the 12 months before the claim, or $50. Some places don’t allow these limits, so they may not apply to you.
13. Indemnity
If someone makes a claim against us because of content you uploaded or made, or because you broke these terms or the law, you’ll cover our reasonable losses and costs from that claim.
14. Governing law and disputes
These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of law rules. Disputes will be resolved in the state courts in St. Louis County, Missouri, or the federal courts for the Eastern District of Missouri, and you and we agree to their jurisdiction. Either of us may use small claims court instead. Before starting a claim, please email support@emotemaker.ai so we can try to sort it out. This doesn’t take away rights you have under the laws where you live.
15. Changes to these terms
We may update these terms. We’ll post the new version here and change the date at the top. If a change is significant, we’ll also tell you by email or on the site. If you keep using EmoteMaker after a change takes effect, you accept the new terms.
